Terms & Conditions

Effective Date: October 26, 2026
Last Updated: October 26, 2026

Welcome to AIIZ Marketing. These Terms & Conditions (“Terms”) govern your access to and use of aiizmarketing.live, our marketing services, subscription plans, lead generation programs, automation services, and related offerings.

In these Terms, “AIIZ Marketing,” “we,” “our,” and “us” refer to AIIZ Marketing. “You” and “your” refer to any person or business accessing our website or using our services.

By accessing our website, submitting a form, purchasing a service, or using our services, you agree to these Terms. If you do not agree, do not use our website or services.

1. Our Services

AIIZ Marketing provides digital marketing and business growth services that may include:

  • Branding and creative services

  • Social media management

  • Website and landing page development

  • Sales funnel development

  • Digital advertising management

  • Lead generation services

  • AI automation and business systems

  • Customer relationship management (CRM) setup

  • Email marketing and follow-up campaigns

  • Marketing strategy and consulting

  • Mobile app access or related digital tools

  • Other services described on our website or in a written proposal

The availability, features, deliverables, pricing, and scope of each service are determined by the applicable offer, order, subscription, or written agreement.

We may update, improve, discontinue, or modify services as reasonably necessary, subject to applicable agreements and law.

2. Lead Starter Plan and Free Mobile App Offer

AIIZ Marketing may offer eligible customers access to a mobile app at no additional charge when they sign up for a qualifying Lead Starter plan.

Unless a written offer states otherwise:

  • The Lead Starter plan is priced at $500 per month.

  • The mobile app offer is conditional on enrolling in and maintaining the qualifying plan.

  • App access may require account registration, onboarding, acceptance of applicable app terms, and compliance with service requirements.

  • App features, access limits, and supported functionality may vary.

  • The app offer is not redeemable for cash and may not be transferred to another person or business.

  • Third-party charges, advertising expenses, messaging fees, or other costs are not included unless expressly stated in writing.

We will disclose any material eligibility requirements, additional charges, or limitations associated with the offer before enrollment.

If the qualifying subscription is canceled or becomes inactive, complimentary app access may end, subject to any separate written agreement or applicable law.

We may modify or discontinue promotional offers prospectively. Any change affecting an existing customer will be handled in accordance with the applicable agreement and law.

3. Pricing and Service Scope

Prices displayed on our website are intended to describe our available services and standard pricing at the time shown.

Unless expressly stated otherwise:

  • One-time projects and recurring subscriptions are billed separately.

  • Custom projects may require a written proposal or statement of work.

  • Additional work outside the agreed scope may incur additional charges.

  • Third-party software, domain registration, hosting, advertising spend, stock media, premium integrations, and messaging charges are separate unless expressly included.

  • Taxes, if applicable, may be added to charges.

A service is not included merely because it appears in a general marketing description. The deliverables included in your purchase will be determined by the applicable plan, order, or written agreement.

We may correct obvious pricing or typographical errors before accepting an order.

4. Payments and Billing

One-Time Projects

Unless otherwise agreed in writing, one-time projects may require a deposit before work begins, with the remaining balance due before final delivery or launch.

Larger projects may use milestone-based billing as stated in the proposal.

Monthly Subscriptions

Recurring services are billed in advance at the rate stated at enrollment or in your service agreement.

You authorize the applicable payment provider to charge your selected payment method for recurring charges until the subscription is canceled in accordance with the applicable terms.

Failed Payments

If a payment fails, we may notify you and request updated payment information. We may pause work, restrict access, or suspend services for overdue balances, subject to applicable law and any controlling agreement.

You remain responsible for charges incurred before an effective cancellation date.

Price Changes

We may change subscription pricing by providing reasonable advance notice. Any price increase will apply as permitted by your agreement and applicable law. If you do not accept a proposed increase, you may cancel before it takes effect where permitted.

5. Subscription Terms and Cancellation

Some services may be offered on a month-to-month basis, while others may include an initial commitment period stated in the applicable offer or written agreement.

We may recommend a three-month initial period for marketing campaigns because results often require time to evaluate. A recommendation does not create a binding minimum term unless the applicable agreement expressly states one.

To cancel a subscription, use the cancellation method specified in your service agreement or contact:

Email: [email protected]
Phone: 937-355-7919

Your cancellation becomes effective according to the applicable agreement and any mandatory legal requirements. Unless otherwise stated in writing or required by law, charges already paid are not prorated or refunded for unused time.

Canceling an AIIZ Marketing subscription does not automatically cancel third-party subscriptions, advertising accounts, hosting services, or other services billed directly by external providers.

6. Refunds and Project Deliverables

Because marketing services may involve reserved time, strategy, creative work, setup, or customized deliverables, payments may be nonrefundable once work has begun, except where a refund is expressly promised in writing or required by law.

For project work:

  • Deposits may cover onboarding, planning, scheduling, and initial production.

  • Work completed before cancellation may remain payable under the applicable agreement.

  • Final files, access, or deliverables may be withheld until outstanding balances are paid, to the extent permitted by law and the agreement.

  • Any specific refund policy included in a signed proposal or order will govern that purchase.

Nothing in these Terms limits a refund or remedy that cannot legally be excluded.

7. Client Responsibilities

To help us provide services effectively, you agree to:

  • Provide accurate, complete, and current information.

  • Supply necessary content, brand assets, approvals, and access credentials in a timely manner.

  • Ensure you have rights to all materials you provide.

  • Review and approve deliverables within reasonable timeframes.

  • Maintain access to your relevant accounts and payment methods.

  • Ensure that your products, services, offers, and business practices comply with applicable laws.

  • Obtain any required permissions or consent before providing third-party personal information to us.

  • Use our services lawfully and in accordance with platform rules.

Delays in providing information, access, approvals, or materials may affect delivery schedules and campaign performance.

8. Advertising and Lead Generation

AIIZ Marketing may assist with advertising campaigns, lead capture pages, marketing funnels, automated follow-up, and related activities.

You acknowledge that:

  • Advertising spend is separate from management fees unless expressly included in writing.

  • Advertising platforms control their own review processes, delivery systems, targeting restrictions, and account policies.

  • We cannot guarantee that an advertisement will be approved, remain active, or reach a particular audience.

  • Lead volume, lead quality, conversions, revenue, customer acquisition costs, and return on investment vary and are not guaranteed.

  • Campaign results depend on factors beyond our control, including market conditions, competition, pricing, customer behavior, budgets, and your sales process.

  • You are responsible for following up with leads and fulfilling your own products or services unless otherwise agreed in writing.

We will not knowingly promise guaranteed leads, revenue, or business outcomes unless a specific written agreement expressly provides a measurable guarantee and its conditions.

9. Marketing Communications and Legal Compliance

If we provide email marketing, SMS messaging, lead follow-up, appointment reminders, or related services, you are responsible for ensuring that your business has the necessary legal rights, notices, permissions, and consent to contact recipients.

You agree to comply with applicable laws and regulations governing marketing communications, privacy, telemarketing, consumer protection, and data security, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), applicable Federal Communications Commission rules, and relevant state laws, as applicable.

You must not use our services to send unlawful, deceptive, unsolicited, or prohibited communications.

Where applicable, you must honor unsubscribe requests, do-not-call requirements, and STOP or other opt-out requests promptly.

AIIZ Marketing may suspend or restrict a campaign or account if we reasonably believe it violates law, platform policies, or these Terms.

10. AI Tools and Automated Services

Our services may use AI-powered systems for content generation, chat responses, lead qualification, scheduling, marketing analysis, and workflow automation.

You acknowledge that AI-generated outputs may contain errors, omissions, or inaccurate information and should be reviewed before publication or use in important decisions.

Unless expressly agreed in writing, AIIZ Marketing does not guarantee that AI-generated content will be unique, error-free, legally compliant for your particular use, or suitable for every purpose.

You are responsible for reviewing and approving customer-facing content, offers, claims, and automated communications used by your business.

You must not use AI or automation services to impersonate individuals unlawfully, mislead consumers, generate prohibited content, or violate applicable privacy or consumer-protection laws.

11. Mobile App and Third-Party Platforms

Access to any mobile app, CRM, hosting service, payment platform, advertising platform, messaging provider, or other third-party system may be subject to separate terms and privacy policies.

We do not control the availability, performance, or policies of independent third-party providers.

You are responsible for maintaining any third-party accounts required for your services and paying fees charged directly by those providers unless otherwise stated in writing.

We do not guarantee uninterrupted access to third-party platforms or services.

12. Intellectual Property

AIIZ Marketing Materials

Unless otherwise stated in writing, AIIZ Marketing retains ownership of its website, brand assets, proprietary methods, templates, internal processes, and pre-existing materials.

You may not reproduce, distribute, sell, or commercially exploit our proprietary materials without prior written permission.

Client Materials

You retain ownership of the materials you provide to us, subject to any rights necessary for us to perform the agreed services.

You grant us a limited, nonexclusive license to use, reproduce, modify, and display those materials as reasonably necessary to provide the services you request.

You represent that you have the rights and permissions needed to provide those materials and authorize their use.

Custom Deliverables

Ownership, licensing, and usage rights for custom deliverables will be governed by the applicable proposal or written agreement. Unless otherwise stated, transfer of ownership or delivery of final files may be contingent on full payment.

Third-party assets, stock images, fonts, software, and other licensed materials remain subject to their respective license terms.

13. Website Use and Prohibited Conduct

You agree not to:

  • Use our website or services for unlawful purposes.

  • Attempt unauthorized access to our systems or accounts.

  • Interfere with the security, integrity, or operation of our website.

  • Upload malicious code or harmful files.

  • Misrepresent your identity or business.

  • Infringe intellectual property or privacy rights.

  • Use our services for fraud, spam, phishing, or deceptive marketing.

  • Circumvent access restrictions or misuse promotional offers.

  • Resell or redistribute access to our services without authorization.

We may restrict or terminate access where reasonably necessary to protect our business, customers, systems, or legal interests.

14. Confidentiality and Data Protection

Each party may receive nonpublic information from the other while working together.

The receiving party agrees to use reasonable care to protect confidential information and use it only for the purpose for which it was provided, subject to applicable law and any separate confidentiality agreement.

Confidentiality obligations do not apply to information that is publicly available through no breach, independently developed, lawfully received from another source, or required to be disclosed by law.

Our collection and use of personal information are described in our Privacy Policy.

15. No Guarantee of Business Results

AIIZ Marketing provides marketing services and tools intended to support business growth.

We do not guarantee specific outcomes, including:

  • A particular number of leads, customers, bookings, or sales

  • A specific level of revenue, profit, or return on advertising spend

  • Search engine rankings or social media reach

  • Advertising approvals or uninterrupted campaign delivery

  • Funding approvals, financing, or credit outcomes

  • Any particular business result or timeline

Past performance, examples, testimonials, estimates, and projections are not guarantees of future results.

You remain responsible for your business decisions, offers, pricing, sales process, customer service, and fulfillment.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website and services are provided on an “as available” and, where permitted, “as is” basis.

We disclaim warranties that cannot lawfully be excluded, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement, to the extent permitted by law.

We do not warrant that our website, software integrations, automated systems, or third-party services will always be uninterrupted, secure, error-free, or compatible with every system.

17. Limitation of Liability

To the fullest extent permitted by applicable law, AIIZ Marketing will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, data, goodwill, or anticipated savings arising from or related to your use of our website or services.

To the fullest extent permitted by law, AIIZ Marketing's total liability for claims arising from a particular service will not exceed the amount you paid to AIIZ Marketing for that service during the three months immediately preceding the event giving rise to the claim.

These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless AIIZ Marketing and its owners, personnel, and service providers from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful use of our website or services.

  • Your violation of these Terms.

  • Materials, claims, offers, or content you provide or direct us to publish.

  • Your failure to obtain required permissions or consent.

  • Your violation of another person's rights or applicable law.

This provision does not require you to indemnify us for our own liability to the extent such indemnification is prohibited by law.

19. Suspension and Termination

We may suspend or terminate access to our website or services where reasonably necessary because of nonpayment, unlawful activity, security concerns, material violations of these Terms, or risks to our business or other users.

Where appropriate and legally required, we will provide notice and an opportunity to resolve the issue.

Termination does not eliminate payment obligations incurred before the effective termination date or provisions that by their nature should survive termination.

20. Changes to These Terms

We may revise these Terms from time to time.

The “Last Updated” date will reflect the latest revision. Where legally required, we will provide notice of material changes or obtain consent.

Changes will apply prospectively unless otherwise required by law or agreed in writing.

21. Governing Law and Disputes

These Terms will be governed by the laws of the State of Ohio, without regard to conflict-of-law principles, unless applicable law requires otherwise.

Any dispute arising from these Terms or our services will be handled in a court of competent jurisdiction, subject to applicable law and any separate written agreement between the parties.

Nothing in this section limits rights or remedies that cannot lawfully be waived.

22. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Our failure to enforce a provision does not waive our right to enforce it later.

23. Entire Agreement

These Terms, together with our Privacy Policy and any applicable written proposal, order, or service agreement, govern your use of our website and services.

If a signed service agreement conflicts with these Terms, the signed agreement will control for the specific service to the extent of the conflict.
